The meeting was called to order by President Gruber at 6:02 p.m.
Rob Roth from General Engineering reviewed the Developer’s Agreement he created with the Village Board section by section. Changes made from his rough draft were as follows:
- Page 1, Part C: Strike “site grading operations” from the “Public Improvements.”
- Page 2, Section 1.2(1): Add “(d) Provide opportunity for future business growth.”
- Page 2, Section 1.3(1)(a): Strike “(excluding site grading.)”
- Page 3, Section 1.4(1)(a): Strike “Site Grading of the anticipated building site within the TID.”
- Page 3&4 Section 2.3(1)(b): Add “and functional” so the paragraph states “The security furnished shall be held until all of the Public Improvements required by this Agreement are completed and functional, as documented by the Village Engineer.”
- Page 3&4 Section 2.3: two options for short term financial guarantees, Board thought Option 2 would be more appropriate, “Developer to Agree to Special Assessment Procedure in the event of a Discontinuance of the Project.”
- Page 5 Section 2.4(1): Date adjustment from May 9, 2006 to December 28, 2006 (In two places in that paragraph)
- Page 5 Section 3.2(1): Change “The Developer may commence” to “The Developer shall commence.”
- Page 6 Section 4.2(1): Change “The Developer may apply” to “The Developer shall apply.”
Rob will make the requested changes. The Village Attorney should review the agreement.
Trustee Liegel motioned to recess at 6:55 p.m. This was seconded by Buchanan and carried unanimously.
Trustee Murry motioned to reconvene at 7:25 p.m. after the Caucus. This was seconded by Liegel and carried unanimously.
Murry motioned to accept the Certified Survey Map in which Linda Paulus has dedicated to the public a portion of St. Luke’s Avenue. This was seconded by Leeck and the motion carried unanimously.
Discussed next was the Attorney’s recommendation concerning zoning for Commercial buildings containing residential dwellings. According to Sauk County Planning and Zoning, all other Villages in
Trustee Buchanan asked if there was any objections to putting a poll question on the Village Website which states “Has the
